Session Overview

With a focus on healthcare due to it being the number one setting for workplace violence, Elizabeth McIntyre and Janet Borowy (Cavalluzzo Hayes Shilton McIntyre & Cornish LLP) discuss their work with clients who are subject to trauma. Beginning with a series of definitions and sources of workplace violence and harassment, as well as an overview of Canadian law, Ms. McIntyre and Ms. Borowy move into a discussion of the Occupational Health and Safety Act and the Ontario government response in the form of Bill 168. Ms. Borowy delves deeply into the Criminal Code’s Westray Provisions: the legal duties for workplaces and rules for attributing criminal liability. Ms. McIntyre also analyzes several cases of workplace violence and looks at the shifts in law and policy regarding the DuPont measures.
